Terms and Conditions
1. Purpose
These Terms and Conditions of Sale (CGV) govern the sale of digital products offered by PGU MEDTEC, including but not limited to 3D models, Blender add‑ons, and bundles. In accordance with Article 1103 of the French Civil Code, “Contracts lawfully entered into shall have the force of law for those who have made them.” Placing an order constitutes full and unconditional acceptance of these CGV.
2. Products
The products offered are downloadable digital creations. No physical delivery is provided. Each product includes a detailed description and an applicable license of use. In accordance with French Law No. 2004‑575 of June 21, 2004 (LCEN), PGU MEDTEC provides clear and transparent information about its products.
3. Prices and Payment
Prices are indicated in euros, inclusive of all taxes (TTC).
3.1. Online sales (via Payhip)
Payments are processed through the Payhip platform using its secure payment providers, including Stripe and PayPal. PGU MEDTEC does not store or process any banking data; such data is handled exclusively by the payment providers in compliance with the GDPR (EU Regulation 2016/679).
3.2. Direct sales to businesses and organizations (B2B / B2G)
Sales to companies, healthcare institutions, universities, government bodies, or any other organization may be conducted outside of Payhip, including:
via quotation,
via pro‑forma invoice,
via purchase order,
by bank transfer,
or through a secure Stripe payment link.
In accordance with Article L441‑10 of the French Commercial Code, invoices are payable under the terms agreed between PGU MEDTEC and the purchasing organization.
The licensing conditions applicable to digital products remain those defined in the general License Agreement, as well as any additional specific clauses applicable to each product.
4. Download and Access
After payment validation, the buyer receives a download link provided either by Payhip or by PGU MEDTEC (for B2B/B2G transactions).
This link is personal and may not be shared.
PGU MEDTEC does not guarantee compatibility of the products with all versions of Blender or other third‑party software.
5. Withdrawal Right and Refund Policy
Under Article L221‑18 of the French Consumer Code, consumers have a 14‑day withdrawal period.
However, Article L221‑28 of the French Consumer Code provides an exception:
“The right of withdrawal cannot be exercised for contracts for the supply of digital content not provided on a physical medium, where performance has begun after prior express consent of the consumer.”
Therefore, no refund is possible once the file has been downloaded, except in the event of a proven technical defect.
This rule also applies to B2B/B2G sales when the digital product is delivered immediately.
6. Warranties and Liability
PGU MEDTEC guarantees that the files are free of viruses and usable under the conditions described.
In accordance with Articles 1641 et seq. of the French Civil Code, PGU MEDTEC remains liable for hidden defects.
PGU MEDTEC cannot be held responsible for damages resulting from misuse, software incompatibility, or unauthorized modification of the files.
7. Intellectual Property
All digital products remain the exclusive property of PGU MEDTEC. Purchasing a product grants a right of use under the applicable license but does not transfer any intellectual property rights. This clause complies with Articles L111‑1 et seq. of the French Intellectual Property Code.
8. Personal Data
Data collected during the order process is handled by Payhip and its payment providers, including Stripe and PayPal. PGU MEDTEC only accesses information necessary for customer support and complies with the GDPR (EU 2016/679). The buyer has rights of access, rectification, deletion, and objection under Articles 15 to 22 of the GDPR.
9. Governing Law and Jurisdiction
These CGV are governed by French law. In the event of a dispute, exclusive jurisdiction is assigned to the courts within the jurisdiction of the Judicial Court of Évry‑Courcouronnes, in accordance with Article 42 of the French Code of Civil Procedure.
